Just hours before it was scheduled to take effect, a district court judge on Wednesday reportedly blocked the Biden administration’s new regulation that would have charged gun owners who failed to register their braced guns with a crime.
The Bureau of Alcohol, Tobacco and Firearms and Explosives (ATF) issued a “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces'” rule in January stating that all gun owners who possess “stabilizing braces,” shoulder devices that convert pistols into short-barreled rifles, must register their firearms and adhere to the laws governing those types of weapons or risk facing felony charges.
Texas and numerous pro-gun organizations sued the ATF, and on Wednesday, Southern Texas District Court Judge Drew Tipton ordered a preliminary injunction stopping the rule’s implementation on June 1.
The court said in the eight-page judgment that Texas had proven that the regulation would cause “irreparable harm” if it were to be implemented before the case was resolved.
Texas contended the regulation would bar its residents and police officers from self-defense in its application for a preliminary injunction.
