Federal Court Strikes Down Attempt to Give So-Called ‘Dreamers’ ACA Coverage

A federal court in North Dakota has now reportedly struck down coverage under the Affordable Care Act (ACA) for immigrants who entered the United States illegally as minors.

These individuals are commonly referred to as “Dreamers.”

According to the documents filed in the case, United States District Judge Daniel M. Traynor granted a stay on a final rule issued by the Biden administration that would allow certain Dreamers to use the marketplace for the Affordable Care Act (ACA) on Monday.

This decision was also granted to 18 other states.

A preliminary injunction was also issued to Kansas and the other states, which prevented the federal government from “enforcing the Final Rule against” them.

“The authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term “lawfully present,” Traynor remarked in the ruling.

Following the announcement of the final regulation from the Centers for Medicare and Medicaid Services (CMS) in May, the administration of Vice President Joe Biden made it possible for active recipients of Deferred Action for Childhood Arrivals (DACA) to enroll in a qualifying or basic health plan under the Affordable Care Act (ACA), in addition to receiving various forms of financial help.

As a consequence of previous CMS regulations, DACA beneficiaries have been seen as persons who are not “lawfully present” in terms of health care law.

As a consequence, some DACA recipients have lost their coverage opportunities.

A statement released on Monday by Kansas Attorney General Kris Kobach (R), who is a leader among those who are opposed to the ultimate decision in the case, expressed his satisfaction with the ruling.

“This decision is a big win for the rule of law. Congress never intended that illegal aliens should receive Obamacare benefits. Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws. But we fought back and defeated the Biden Justice Department.” Kobach said.
