On Thursday, the Democratic commissioners of Bucks County, Pennsylvania, reportedly voted to permit the counting of undated and misdated ballots.
This decision was made in anticipation of a recount in the contest between Democratic Pennsylvania Sen. Bob Casey and Republican Senator-elect Dave McCormick, which Casey lost.
Diane Ellis-Marseglia and Robert Harvie, commissioners of Bucks County, attempted to permit the counting of undated or misdated ballots in the critical swing county, despite a state supreme court judgment on November 1 that prohibited the counting of such ballots.
As the Casey-McCormick Senate election approaches a recount, the commissioners voted to do so, with McCormick leading by approximately 25,000 votes.
Other counties in the state, such as Centre County, Philadelphia County, and Montgomery County, have also implemented policies that permit the counting of ballots that are inaccurately or undated.
McCormick and his Republican allies filed lawsuits against the Bucks County decision on Thursday.
Democrat election counsel Marc Elias, who was responsible for the The Steele Dossier, is currently involved in the Democrats’ endeavor to overturn the results of the Pennsylvania Senate race.
In the past, Elias has been involved in a number of lawsuits to attempt to validate problematic or disqualified ballots in favor of Democrats. For example, his efforts in 2008 were instrumental in the election of former Democratic Minnesota Sen. Al Franken.
