The conditions of Hunter Biden’s plea deal and pretrial diversion arrangement, according to his attorneys, were reportedly largely dictated by Department of Justice (DOJ) prosecutors, according to a new court document filed on Sunday evening.
Biden would have entered a diversion arrangement, which would have allowed him to avoid jail time for a felony weapons charge, and pleaded guilty to two misdemeanor tax counts under the plan, which Judge Maryellen Noreika rejected.
A section of the diversion agreement that included a guarantee of broad immunity for any crime mentioned in the attached statement of facts, which detailed payments Biden received from his business dealings in China, Ukraine, and Romania, was revealed by Noreika’s questioning during the hearing on July 26.
Additionally, the legal team for Hunter Biden stated that “the parties have a valid and binding bilateral Diversion Agreement.”
His attorneys also stated that the prosecutors’ “written and oral communications” throughout talks helped them comprehend the extent of immunity being offered—a point the parties contested during the hearing.
In a request filed on Friday, the prosecution stated that a trial is now most probable in Hunter Biden’s case.
Hunter Biden’s criminal charges have been the subject of an investigation by U.S. Attorney David Weiss, who was designated as special counsel in the case on Friday.
